Travis County Requirements
- Standing Order. Travis County has automatic standing orders that take effect immediately upon filing any family law case. You must be aware of and comply with the standing order from the day you file.
- Mandatory Case Review. Self-represented litigants in Travis County must contact the Travis County Law Library to complete a mandatory case review before the final hearing.
- Prove-up options. Travis County judges may accept prove-up affidavits for agreed divorces without children. Confirm with your court coordinator.
Travis County Standing Order
The Travis County Standing Order goes into effect automatically when you file your divorce petition. Key restrictions include:
- Neither party may destroy, hide, or dispose of property (real or personal) owned by either spouse.
- Neither party may harass, threaten, or interfere with the other party.
- Neither party may make withdrawals from retirement accounts without court approval.
- Neither party may cancel, alter, or fail to renew insurance policies covering the other spouse.
- Neither party may incur debt on joint credit accounts beyond reasonable living expenses.

How to File in Travis County

Have your spouse sign the Waiver of Service or Answer form. File the signed document with the clerk.

Wait 60 Days
Texas requires a 60-day waiting period. During this time, comply with the standing order.

Complete Mandatory Case Review
Contact the Travis County Law Library to schedule your mandatory case review. This must be completed before the final hearing.

Finalize the Divorce
Submit the Final Decree and VS-165 form. You may finalize via prove-up affidavit (check with your court coordinator) or attend a brief hearing.
